Absolutely Illegal: Popenko Explained Why Kyiv Residents Overpay for House Maintenance.


Expert Oleg Popenko believes that the competition based on which Kyiv residents are charged higher tariffs for house maintenance is illegal. In particular, Ukrainian laws regarding the cost of cleaning the adjacent territory and the existence of a proper basis for calculating the tariff are being violated.
According to the legislation, the fee for cleaning can only be charged under certain conditions, such as private ownership of the land under the house or residents' consent at general meetings. However, in Kyiv, none of these conditions are met. The land under multi-apartment houses serviced by management companies belongs 100% to the Kyiv City Council. There are also no protocols from residents' general meetings where they agreed to pay for cleaning the adjacent territory.
The requirement for a proper basis for calculating the tariff is also being violated. Multi-apartment buildings should use technical documentation to calculate the maintenance fee, but 70% of the buildings do not have this documentation.
This situation leads to misunderstandings when houses of different sizes and workloads are charged the same maintenance cost. The expert believes that these calculations are unfounded and possibly illegal.
