Legality of the operation of Odesa restaurants and clubs without shelters.


During air alerts, cafes, bars, and restaurants are required to lead visitors to the nearest shelter. However, not all establishments in Odesa have protective structures within a 50-meter radius for quick and safe shelter in case of an attack.
The issue of the necessity of shelter nearby was commented on by the Main Directorate of the National Police in response to a request from the publication Novyny.LIVE.
If there is no shelter nearby
Currently, legislation does not require the presence of a shelter within a 50-meter radius of public catering establishments, and liability for this is not provided by law.
Nevertheless, this does not mean that catering enterprises are not subject to inspection in wartime conditions. The State Emergency Service systematically checks establishments to ensure compliance with safety measures, including the presence of protective structures. After the inspection, an act is drawn up, which is sent to the owner of the establishment for addressing deficiencies.
In the event of an air alert, it is important for public catering establishments to have adequate shelter for protection against possible dangers. Although the law does not require the presence of protective structures within a 50-meter radius, the State Emergency Service regularly checks establishments for compliance with safety requirements.
